Bankruptcy & Rehabilitation case

Bankruptcy in Thailand is governed by Bankruptcy Act B.E. 1940 (2483) which established to protect both the public and the debtor by means of declaring the debtor bankrupt so that he/she would be unable to commit any legal action, and distributing his/her property to the creditors (Liquidation). After three years of bankruptcy, the debtor would get a "fresh start".

A creditor may file a bankruptcy case before the Bankruptcy Court against its debtor who is unable to pay the debt he/she owes to the creditors which is not less than 1 million baht in case he/she is a natural person or an individual, or not less than 2 million baht in case he/she is a juristic person such as company, partnership, etc.

However, the debtor which is a juristic person may request the court for business reorganization or rehabilitation if it owes the debt of 10 million baht or over, and the court has not issued the debtor as bankruptcy yet.

Not only representing the clients at the court as an attorney-at-law , we have been also giving legal advice to them during their rehabilitation process.

คดีล้มละลายและการฟื้นฟูกิจการ

การล้มละลายในประเทศไทยเป็นไปตามพระราชบัญญัติล้มละลาย พ.ศ. 2483 ซึ่งมีขึ้นเพื่อคุ้มครองสาธารณะและตัวลูกหนี้เอง โดยการพิพากษาให้ลูกหนี้เป็นบุคคลล้มละลายซึ่งจะทำให้ลูกหนี้ไม่มีความสามารถทำนิติกรรมหรือดำเนินการใดๆทางกฎหมายได้ เพื่อเฉลี่ยทรัพย์สินของลูกหนี้แบ่งให้แก่เจ้าหนี้ทั้งหลาย เมื่อครบสามปี บุคคลดังกล่าวก็จะถูกปลดจากการเป็นบุคคลล้มละลายทันที

เจ้าหนี้สามารถฟ้องลูกหนี้ต่อศาลล้มละลายเป็นคดีล้มละลายได้หากลูกหนี้ไม่อาจชำระหนี้ได้ โดยมีเงื่อนไขว่าลูกหนี้นั้นเป็นหนี้กับเจ้าหนี้ทั้งหลายรวมกัน จำนวนไม่น้อยกว่า 1 ล้านบาท กรณีที่เป็นบุคคลธรรมดา หรือไม่น้อยกว่า 2 ล้านบาท กรณีที่เป็นนิติบุคคล เช่น บริษัท, ห้างหุ้นส่วน เป็นต้น

อย่างไรก็ตาม ลูกหนี้ผู้เป็นนิติบุคคลอาจขอศาลฟื้นฟูกิจการได้หากลูกหนี้มีหนี้ทั้งหมดรวมกันไม่น้อยกว่า 10 ล้านบาท และศาลยังมิได้มีคำพิพากษาให้เป็นบุคคลล้มละลาย

ไม่เพียงแต่ปรากฏตัวในศาลในฐานะทนายความของลูกความเท่านั้น พี เอ วี ยังให้คำปรึกษาทางกฎหมายแก่ลูกความในขั้นตอนฟื้นฟูกินการอีกด้วย
